SABA-DC IP Law Section Presents: Patent Damages Update


Patent Damage awards, some of the highest in civil litigation; have been making the headlines for decades.  Damage verdicts in the hundreds of millions of dollars are not uncommon and are a large part of the reason corporations have invested so heavily in their patent portfolios.  In the past five years, however, median damage awards as a whole have been trending downwards. And an increasing number of large awards are being struck down and reduced as the judiciary has taken an unfavorable view on large verdicts.


Join us for a thought-provoking panel discussion as Anand Sharma and Dr. Rajeev Gupta, partners at Finnegan, discuss the reasons for some of these trends, a review of some of the recent case law, and best practices in obtaining a damages award that stands up.  The panel will be moderated by Rahul Das, patent development manager at Intellectual Ventures.

Presenters:     


Anand Sharma, partner at Finnegan, leads the firm’s Mechanical Practice Group, and previously served as chair of Finnegan's Diversity and Inclusion Committee. He has experience in all aspects of patent law, with a particular emphasis on U.S. district court and U.S. International Trade Commission (ITC) Section 337 litigations, as well as strategic client counseling. Mr. Sharma has extensive experience managing patent portfolios, counseling clients on strategic patent planning in areas such as patent procurement, post-grant  proceedings, licensing, and pre-enforcement considerations.  He has considerable experience in trial practice, including directing and cross-examining dozens of witnesses in jury and bench trials, arguing discovery, Markman and summary judgment motions, and leading settlement and mediation negotiations.


Rajeev Gupta is a partner at Finnegan.  Dr. Gupta focuses his practice on patent litigation in the U.S. district courts and the U.S. International Trade Commission (ITC), strategic patent prosecution, and client counseling. He has considerable experience in a wide range of technologies including telecommunications, semiconductors, smartphones, video game technologies, software, and in areas pertaining to fabrication and characterization of nanodevices.


Dr. Gupta has broad experience in all aspects of patent litigation, including examining and cross-examining fact and expert witnesses at trial, taking and defending depositions, and managing day-to-day litigation activities. He also has a wide range of experience involving post-grant proceedings, where he has served as co-lead counsel for several proceedings, and reexamination matters.
