Legal Consequences of Environmental Disasters
 
The BP oil spill has created an environmental disaster whose impact is not yet known.  But it is apparent that this incident will burden the affected areas for years to come with innumerable economic, sanitary, legal, and ecological issues.  SABA-DC invites you to join Neal Kemkar, Special Assistant Counselor to the Secretary, U.S. Department of the Interior and Seema Kakade, Attorney at the U.S. Environmental Protection Agency, for our August Dinner Series, which will be an informal discussion on the environmental legal and policy issues that surround the BP Oil Spill, including comparisons to the Exxon Valdez Oil Spill, natural resource damage concerns, and liability/penalties.  Space is limited, so please RSVP to Dharmesh Vashee at dinner@sabadc.org by August 24.  Details are below.  We look forward to seeing you there.

SABA-DC July Dinner Series

The Hot Topic of Arizona SB-1070 

Arizona recently enacted SB-1070, the most controversial immigration-related measure in decades. SB-1070 is scheduled to go into effect on July 29, 2010.  SB-1070 makes it a state misdemeanor crime for an immigrant to be in Arizona without carrying immigration documents, steps up state and local law enforcement of federal immigration laws, and penalizes those sheltering, hiring and transporting illegal immigrants. Critics of the legislation state it encourages racial profiling, while supporters state that it simply enforces existing federal law. 

On July 6, 2010, the U.S. Department of Justice filed a lawsuit challenging SB-1070, thereby sending a clear message that it will not tolerate state laws that invite racial profiling and interfere with federal immigration priorities and policies. Other groups previously filed a lawsuit in May challenging the constitutionality of the law.

Jayesh Rathod is an expert in immigrants' rights, labor and employment, occupational safety and health, and the intersection of law and organizing. He was previously a Staff Attorney at CASA of Maryland , representing low-wage immigrant workers on employment law and immigration matters, and participating in worker education, organizing, and advocacy efforts. He also practiced in the litigation section at Wilmer, Cutler & Pickering LLP, and was law clerk to the Honorable Louis F. Oberdorfer, of the United States District Court for the District of Columbia. Over the course of his career, he has worked with numerous non-governmental organizations to advance the civil and human rights of communities in the United States and abroad.

An Evening with Ambassador Shankar P. Sharma

Please join SABA-DC at 7:00 p.m. on Wednesday, July 14 for dinner with Dr. Shankar P. Sharma. Dr. Sharma is, as of 2010, the Nepalese Ambassador to the United States.
 
He will discuss the overall economic situation of the country and its challenges and impact on the global crisis, as well as address peace building efforts in Nepal.
 
Dr. Sharma has extensive experience in government, international institutions and economic consultancy. Before joining the National Planning Commission, he was Senior Economic Advisor at the Ministry of Finance; Senior Economist in the Institute of Southeast Asian Studies, Singapore; and a Fellow in the East-West Center, Hawaii. He also served as a Professor of Economics at the Centre for Economic Development and Administration, Tribhuvan University, Nepal.

Dr. Sharma was editor of the ASEAN Economic Bulletin and a consultant editor to Hydrocarbon Asia, both published in Singapore for about seven years. He has published eight books (edited or authored) and more than fifty articles on the economy, energy and the environment of the Asia-Pacific region, including Nepal.

He has been decorated by Subikyat Gorkha Dakchhin Bahu (2004), Bikhyat Trishaktipatta (2001), Suprabal Gorkha Dakchhin Bahu (1998), and Mahendra Vidya Bhusan (1986) by His Majesty the King of Nepal.

Interviews taken with him have appeared in prestigious newspapers and magazines published from all over the world including, Asia Week, International Herald Tribune, Straits Times, Business Times (Singapore and Malaysia), New Straits Times, Bangkok Post, Forbes, Japan Times, Los Angeles Times, and almost all newspapers and magazines published from Nepal.

Dr. Sharma earned his Ph.D. in Economics from the University of Hawaii.

SABA-DC Pro Bono Clinic

SABA-DC provides pro bono assistance on a quarterly basis through the D.C. Bar Pro Bono Program's monthly Advice and Referral Clinics.  We are currently seeking four to five volunteer attorneys to staff the Saturday, June 12 clinic.  Additional clinics in 2010 will be held on September 11 and December 11.

Attorneys with limited experience are welcome to volunteer; expert mentors and other resources will be available on site.  Law students may volunteer to provide non-legal assistance in the form of interviewing clients prior to their consultations.

SABA-DC April Dinner Series:

A View of the Supreme Court

Please join SABA-DC in hosting Sri Srinivasan, Partner at O'Melveny & Myers, for SABA-DC’s April Dinner Series focusing on Sri's career in apellate work at the US Supreme Court.  Sri has argued numerous cases before the U.S. Supreme Court, and has briefed countless others in the Supreme Court and the lower federal courts on a broad array of legal and constitutional issues. Sri’s arguments in the Supreme Court have encompassed such areas as federal preemption, federal court jurisdiction, banking law, federal contracting law, administrative law, criminal law and procedure, immigration law, and education law. In addition his work in the Supreme Court, Sri is presently involved in a number of matters in federal and state court addressing a wide variety of subjects, including patent and intellectual property law, antitrust law, labor law, First Amendment law, federal preemption, and tax law. 

Before returning to O’Melveny in 2007, Sri was in the Office of the Solicitor General for a period of five years. Prior to this, he clerked for the Honorable Sandra Day O'Connor of the US Supreme Court and the Honorable J. Harvie Wilkinson III, for the US Court of Appeals for the Fourth Circuit.
 
Sri will discuss the three cases he has argued at the Court this term and give his views on the Stevens' legacy. There will be ample time for questions!

Citizenship Eligibility Requirements
• Be at least 18 years old by the date you file.
• Have been a lawful permanent resident for at least 5 years (or 3 years if married to a U.S. citizen).
• Have been present in the U.S. for 2.5 out of the past 5 years (1.5 out of the past 3 if married to a U.S.
citizen) and have not been outside the U.S. for 1 year or more within the last 5 years (3 if married to a U.S.
citizen).
• Have been a resident of the state from which you are filing your application for at least 3 months.
• Be able to speak, read, and write ordinary English. (Exemptions may apply in some cases.)
• Be able to pass a U.S. civics test. (Exemptions may apply.)
• Be a person of “good moral character” (this will be difficult to establish if you have failed to pay child
support, taxes, or have been convicted of crimes, among other things).
• Be willing to take an oath of loyalty to the United States.

• 2 color passport photos.
• List of home addresses for the past five years and the dates in which you resided at these addresses.
• List of employer names and addresses for the past five years, including the dates you worked with these employers.
• Birth dates and data for your spouse (current and former) and ALL children (including adult, adopted and deceased)
– date and place of birth, A#, Green Card, and current address.
• Dates you have been outside of the U.S. since becoming a permanent resident and the countries visited on each trip.
• If necessary, bring interpreter to translate.

• If the name on your green card is different than your current legal name:
   o Bring the documents that legally changed your name (marriage certificate, divorce decree, or court
   document)
• If you are applying for US citizenship based upon marriage to a US citizen bring:
• Proof your spouse had been a citizen for the past 3 years (spouse’s birth certificate, naturalization
certificate, certificate of citizenship, US passport, or form FS240);
• Current marriage certificate;
• Proof of termination of all prior marriages of your spouse (divorce decree(s), annulment(s), or death
certificate(s));
• Document showing that you and your spouse are still living together (examples: tax returns, bank
statements, leases, mortgages, birth certificates of your children, IRS-certified copies of income taxes for
the past three years)

• If you have been married more than one time:
   o Bring proof that ALL earlier marriages ended (divorce decree(s), annulment(s), or death certificate(s)).

• If you have taken a trip outside the US lasting longer than 6 months since becoming a Permanent Resident
bring:
   o IRS tax return “transcript” for the last 5 years (or last 3 years if married to a US citizen);
   o Rent or mortgage payments; pay stubs.
• If you have a dependent spouse or children who do not live with you bring:
o Any court order to provide financial support;
o Evidence of your financial support (examples: canceled checks, money orders receipt, evidence of wage
garnishments, or letter from parent of guardian who cares for your children).
• If you think you have been arrested, detained, or if you have had to appear before a court for any reason
whether in the last five years or earlier:
   o Bring ALL documents relating to the arrest, conviction, court appearance, and final disposition.

SABA-DC provides pro bono assistance on a quarterly basis through the D.C. Bar Pro Bono Program's monthly Advice and Referral Clinics.  We are currently seeking four to five volunteer attorneys to staff the Saturday, March 13 clinic.  Additional clinics in 2010 will be held on June 12, September 11, and December 11.
Attorneys with limited experience are welcome to volunteer; expert mentors and other resources will be available on site.  Law students may volunteer to provide non-legal assistance in the form of interviewing clients prior to their consultations.

Challenges to M&A in India from the New Competition Act

In 2007, India’s Competition (Amendment) Act (“Act’) introduced significant changes to the competition law regime. Most noteworthy of these changes was the introduction of a mandatory notification process for persons undertaking combinations above the prescribed threshold limits. The intent of the Act is to establish merger review and control procedures designed to prevent anticompetitive combinations. The Draft Competition Commission (Combination) Regulations provide a framework for regulation of combinations which include M&A or amalgamations of enterprises. Further, section 6 of the Act prohibits enterprises from entering into agreements that cause or are likely to cause an “appreciable adverse effect on competition within the relevant market in India.” Under the new regime the Competition Commission of India (“CCI”) has investigative powers in relation to a combination. Various factors are examined to determine whether a combination will/is likely to have an “appreciable adverse effect” on competition in India, and sanctions are provided for violations. The recent amendments have significantly changed the review process, and stirred up a significant global controversy. While the merger provisions are not yet in force, relevant provisions will be notified soon. Much has been articulated about the negative impact on M&A activity in India. It is pertinent to examine and evaluate the obstacles to and consequences of such transactional activity.  This timely webinar with leading antitrust practitioners from India and worldwide will provide an overview of the Act and its reach, and discuss merger provisions and implications on business with a specific focus on how it might apply to global companies seeking to do business in India.

Samir Gandhi is a partner in the New York office of Sidley Austin LLP whose practice focuses on private equity transactions and capital markets offerings. Quana Jew, a partner at Arent Fox LLP,  has broad experience in the law of employee benefits. Ms. Jew is skilled in the tax, regulatory and design issues applicable to profit-sharing plans, money purchase pension plans, Section 401(k) programs, Section 403(b) programs, and Section 457 plans. Ms. Jew also designs and advises clients on employee stock ownership plans, executive incentive and deferred compensation arrangements (including but not limited to the rules under Section 409A), and qualified and nonqualified stock option plans. In addition, Ms. Jew counsels clients on employee health and welfare benefit programs, including but not limited to COBRA and HIPAA issues, and fringe benefit programs.
 
Philippa Scarlett is a litigation partner in the Washington, DC office of Kirkland & Ellis LLP.  Her practice includes antitrust as well as complex commercial litigation, in federal and state courts, both at the trial and appellate levels.   Prior to joining Kirkland, Ms. Scarlett served as a law clerk to Justice Stephen G. Breyer of the U.S. Supreme Court and Judge Ann C. Williams of the U.S. Court of Appeals for the Seventh Circuit.  In between her clerkships, Ms. Scarlet was an associate at Boies, Schiller & Flexner LLP where her work focused on high-stakes antitrust litigation.  Ms. Scarlett's pro bono work has included winning asylum in the U.S. for survivors of torture as well as poverty law impact litigation.  Ms. Scarlett also has extensive international experience, having lived in Africa, Asia, Europe, and South America. 
 
A. Neal Seth is a partner at Baker Hostetler and focuses his practice on patent litigation and appeals. He has handled numerous litigation and appellate matters in a variety of technologies, including the pharmaceutical, chemical, electrical and mechanical fields in district courts, the ITC and the Federal Circuit. Beyond his litigation practice, Mr. Seth advises clients on a wide variety of patent matters, including licensing, due diligence, providing opinions of counsel and settling disputes.

William Charyk is the Managing Partner of Arent Fox LLP.  Mr. Charyk’s practice focuses primarily on two specialty areas—taxation of partnerships and employee benefit/executive compensation tax planning.  Mr. Charyk’s work in the partnership tax area involves serving as tax counsel to a wide variety of syndicated and closely held limited partnerships and LLCs, particularly entities with tax-exempt investors.  Mr. Charyk’s practice in the employee benefits/executive compensation area includes implementation of a wide variety of compensation vehicles, including defined benefit pension plans, Section 401(k) programs, employee stock ownership plans (ESOP), and various “nonqualified” executive deferred compensation arrangements such as incentive bonus programs, stock option plans, stock appreciation right plans and phantom stock bonus programs.

-a legal analysis about the strength of the confidentiality protections, including a review of compliance efforts, enforcement mechanisms, and results of Freedom of Information Requests to the government 
-legal procedures dealing with census employees who violate confidentiality 
-an explanation of the confidentiality protections in light of the Illegal Immigration Reform Act of 1996 and USA Patriot Act of 2001 
-the rights and responsibilities of community-based organizations in advising their clients to participate in the census
-the individual benefits for undocumented immigrants to participate in the census

SABA-DC February Dinner Series

SABA-DC February Dinner Series: 180 Degrees - From Defending to Prosecuting Terrorism Cases. 

Please join SABA-DC in hosting Alamdar Hamdani, Trial Attorney in the Counterterrorism Section of the National Security Division of the United States Department of Justice, for SABA-DC’s February dinner series focusing on Mr. Hamdani's career in the fight against terrorism.  Prior to joining the Counterterrorism Section, Mr. Hamdani was a federal prosecutor in the Eastern District of Kentucky, where he prosecuted a wide variety of crimes. Prior to working for the government, Mr. Hamdani was in private practice and represented clients accused of terrorism offenses. In addition to his work as a defense attorney, Mr. Hamdani was a former board member of the American Civil Liberties Union of Texas and represented several South Asians in the broad sweeping FBI interviews that were conduct following 9-11.

Bread for the City's Holiday Helpings campaign provides low-income DC residents with a turkey and all the trimmings so that they may enjoy a celebratory meal at home with their families. Just $28 provides a holiday meal for a family of four.

This year we plan to provide over 8,000 low-income DC families with a nutritious holiday meal. You can help! Last year, with the help of our corporate and community partners organizing food and cash drives,we raised over $500,000 for the Holiday Helpings campaign.  This holiday season, we need to do it all over again...will you join us?
